RUBIN OF SWITZERLAND - GENERAL TERMS AND CONDITIONS (GTC)

(1) CONCLUSION OF CONTRACT

The contract is concluded upon confirmation of acceptance by the seller. The customer submits an offer to the seller by placing the selected goods in the shopping cart and clicking the "buy" button, which the seller then reviews.
The customer also has the option of contacting the seller online to inquire about a specific item. Upon receipt of such an inquiry, the seller will submit a corresponding offer to the customer by email, letter, or fax. A contract is only concluded when the customer accepts this offer.
The contract text will be saved. The customer will receive the contract text via email.

(2) DELIVERY / SHIPPING

Products will be shipped after receipt of payment. Delivery takes place 2 to 4 business days after receipt of payment. Delivery to other European countries is only possible upon prepayment.

(2A) COSTS IN CASE OF NON-DELIVERY

If you provide an incorrect or incomplete delivery address when placing your order and your shipment is returned to us as undeliverable as a result, you will be responsible for any costs incurred.
Shipping will incur a postal service fee of CHF 11.90. You, as the customer, are responsible for paying these fees if you fail to collect your shipment or refuse to accept it.

(3) PRICES / PAYMENT

All prices include VAT plus shipping costs. You can pay with all major credit cards and PayPal, or you can transfer the amount to our bank account.

(4) PAYMENT BY INVOICE

Payment for your order is processed through our partner PowerPay. Your invoice for your order will be sent to you by PowerPay in the following month. This invoice will contain the bank details for your transfer. Please ensure that the billing address matches the delivery address.

(5) CANCELLATION POLICY

Customers who are consumers are entitled to a statutory right of withdrawal. Information about this can be found in the cancellation policy.

(6) WARRANTY

If defects exist, the customer is entitled to the statutory warranty rights in accordance with the following provisions.
Slight color or structure variations in our real hair from the color samples available on the website and the strands on our color rings are possible and do not constitute a right of exchange. Furthermore, it should be noted that, unless otherwise stated, we only process 100% of the hair. Human Hair and therefore cannot offer any exchange/guarantee rights for naturally occurring defects such as split ends, dry tips, shorter lengths or color variations.
Can I dye the extensions?
In principle, yes. However, we don't recommend it, as this type of hair is already depigmented and difficult to bleach. Only use gentle, ammonia-free products. Unfortunately, we cannot guarantee the results. As with every person, this hair is different, as it is 100% Human Hair is.

(7) LIABILITY

In addition to liability for material and legal defects, the seller is liable without limitation if the cause of the damage is based on intent or gross negligence. The seller is also liable for the slightly negligent breach of essential obligations (obligations whose breach jeopardizes the achievement of the contractual purpose) and for the breach of cardinal obligations.
(Obligations whose fulfillment makes the proper execution of the contract possible in the first place and on whose compliance the customer regularly relies), but only for foreseeable, contract-typical damages. The seller is not liable for the slightly negligent breach of obligations other than those mentioned above.

(8) FINAL PROVISIONS

Any changes or additions to these Terms and Conditions must be made in writing. This also applies to the waiver of this written form requirement.
Should individual provisions of this agreement be invalid or contradict statutory provisions, the remainder of the agreement shall remain unaffected. The invalid provision shall be replaced by mutual agreement between the contracting parties with a legally valid provision that most closely approximates the economic meaning and purpose of the invalid provision. The above provision shall apply accordingly to any gaps in the agreement.
PowerPay 
Rubin of Switzerland AG has forwarded the invoice to MF Finance AG (Am Bohl 6 in 9004 St. Gallen; Tel: 071 225 40 30; info@mfgroup.ch; www.mfgroup.ch). The invoice for your order will therefore be sent to you separately by MF Finance AG. Only payments to MF Finance AG will discharge your liability.

I acknowledge that the resulting invoice claim is assigned to PowerPay (MF Finance AG). Furthermore, I agree to the transmission to PowerPay of the data required for processing the invoice purchase and for an identity and credit check. Furthermore, I agree to the PowerPay Terms and Conditions.
